These Terms and Conditions outline the rules and regulations for using our website Avesight.nl
By accessing or using Avesight (“the App,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the App.
1. Description of Service
Avesight enables finance professionals to work with up-to-date and predefined financial datasets (e.g., monthly profit & loss reports) for financial planning and analysis, including forecasting and dashboard creation.
We may update, improve, or discontinue features of the App at any time without prior notice.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using Avesight on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
3. User Responsibilities
When using Avesight, you agree to:
- Provide accurate and lawful information when registering or configuring the App.
- Use the App only for lawful, professional purposes.
- Not share, resell, or misuse data provided by the App.
- Maintain the confidentiality of your account credentials and promptly report any unauthorized use.
4. Data & Privacy
Your use of Avesight is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch privacy laws.
We may integrate with third-party services (e.g., cloud storage, analytics tools) to provide certain features. By using the App, you consent to such integrations.
5. Financial Data Disclaimer
Avesight provides tools and datasets for financial analysis but does not provide financial, legal, tax, or investment advice. Any forecasts, dashboards, or reports generated using the App are for informational purposes only. You are solely responsible for any financial decisions made based on the App’s outputs.
6. Intellectual Property
All content, software, designs, and materials in Avesight are owned by us or our licensors and are protected by Dutch copyright law, EU intellectual property law, and international treaties.
You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.
7. Subscription & Payment
If Avesight offers paid plans, you agree to pay all applicable fees. Payments are non-refundable unless required by Dutch or EU consumer protection laws.
We may change pricing with reasonable prior notice in accordance with Dutch law.
8. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and without liability, except as required by Dutch law.
You may terminate your account at any time by contacting us. Upon termination, you must cease all use of the App.
9. Limitation of Liability
To the fullest extent permitted by Dutch law:
- Avesight and its affiliates are not liable for any indirect, incidental, or consequential damages, including financial losses, resulting from your use of the App.
- The App is provided “as is” and “as available” without warranties of any kind.
This limitation does not affect liability for damages resulting from intent, gross negligence, or other liabilities that cannot be excluded under Dutch law.
10. Indemnification
You agree to indemnify and hold harmless Avesight, its affiliates, and employees from any third-party claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
11. Changes to the Terms
We may update these Terms from time to time. The updated version will be effective upon posting on our website or within the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Netherlands.
Any disputes arising out of or in connection with these Terms shall be exclusively submitted to the competent court in Rotterdam, the Netherlands.
